Overview

Mandatory Arbitration

All disputes between you and Flower Neighbor shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). The arbitrator shall apply the substantive laws of the Federal Judicial Circuit in which Flower Neighbor’s principal place of business is located, without regard to conflict of laws rules.

• Parties must select an arbitrator within 10 days of a demand. If unable, the AAA may appoint one.

• The arbitrator shall decide the enforceability and interpretation of this arbitration agreement per the Federal Arbitration Act ("FAA").

• Emergency measures of protection shall follow AAA rules.

• The arbitrator’s decision is final and binding. No party shall have rights of appeal beyond those provided in Section 10 of the FAA.

• Fees will be shared equally unless otherwise ordered.

• The arbitrator has no authority to award punitive damages. Each party waives the right to seek such damages.

This arbitration clause survives cancellation or termination of these Terms.

Waiver of Class Actions / Jury Waiver

Disputes must be arbitrated solely on an individual basis. You waive the right to class arbitration, class action lawsuits, or jury trials. If any claim proceeds in court, you agree to proceed solely on an individual basis.
